How do you reckon the current fiasco over bank charges is going to finish?

It was interesting to see the county court decision go in the banks favour - and even more interesting to see the banks citing this as a legal precedent in order to - apparently - intimidate people against making further claims against them over charges.
However, I think Tom Brennan probably has a case here:

and he's pushing hard to get a full court hearing.
If he does, I think the banks will lose - they are making profits on debt defaults via a loophole - but even if this is closed, the banks will simply apply the charges elsewhere.
We've already seen a number of credit card companies, most recently Barclays:

suggest charging a fee for "low usage", so I'm sure we'll see more on this.
Overall, if the original bank charges are ruled illegal, I think banks will simply try to charge a little to more customers, rather than a lot to a few.
