Default Title deeds following death

My wife and two sisters are the next of kin to their Aunt who recently passed away. There is no will to speak of, but solicitors have said, due to the three of them being the only living blood relatives, her estate goes to them. This is what she wanted in any case as they were close to one another.

Her property that she left has her former partners name on the title deeds along with her own. Her former partner did not live with her, has his own property and they were not married. I believe there was a small mortgage on the house which is in the Aunts name.

How will this effect my wife and sisters? What are they entitled to? Does anyone know?

Thankyou in advance

Jamie

Default Re: Title deeds following death

If the former partner's name is on the title deeds then the immediate presumption is that he is listed as an owner of the property, and therefore has an interest in it.

However, you really need to get professional legal advice on the matter - if the partner is listed as having an interest in your aunt's estate, then you need to ensure how to address this legally in terms of distributing the inheritance.

A call to someone in the Yellow Pages should help get you started.

Hope that helps a little.
